Antitrust Policy

Linux Foundation meetings involve participation by industry competitors, and it is the intention of the Linux Foundation to conduct all of its activities in accordance with applicable antitrust and competition laws. It is therefore extremely important that attendees adhere to meeting agendas, and be aware of, and not participate in, any activities that are prohibited under applicable US state, federal or foreign antitrust and competition laws.

Examples of types of actions that are prohibited at Linux Foundation meetings and in connection with Linux Foundation activities are described in the Linux Foundation Antitrust Policy available at http://www.linuxfoundation.org/antitrust-policy. If you have questions about these matters, please contact your company counsel, or if you are a member of the Linux Foundation, feel free to contact Andrew Updegrove of the firm of Gesmer Updegrove LLP, which provides legal counsel to the Linux Foundation.

Meeting Outline

GSF Policy WG Summary Notes

Creating a policy manual for software sustainability.
Namrata suggests reaching out to NTT DATA's policy working group for input on software sustainability policies.

Creating a shared agenda for policy analysis in a nonprofit ecosystem.
Chris proposed the idea of creating a shared agenda to track and analyze new legislation and policies. The aim is to help organizations understand the impact of these developments. Chris has raised some questions regarding how to approach the analysis of new legislation and ensure that the GSF (or any organization) is performing its due diligence. Chris is supportive of large organizations that are willing to contribute to the creation of a manual that will aid in tracking and analysing legislation and policies.

Impact of recent climate change legislation on the software industry.
Lisa: Worried about spending time on something that may not pass, so focusing on concrete legislation with clear implications (California Climate Corporate Accountability).
WG: Looking at legislation that has passed and its implications, rather than upcoming legislation (e.g. financial sector looking at legislation affecting them).
Lisa: Opportunity for GSF to offer knowledge and tools to help companies respond to legislative requirements (e.g. prevent greenwashing claims).
WG: Practitioners should ask questions to leadership and product developers about how legislation will impact them.

Green software and its intersection with financial and tech sectors.
Lisa expresses concern about the lack of engagement in the policy working group, with only a consistent group of 4-5 people participating. Sean suggests that the group needs more direction and clarity on what they are working on in the policy manual and how their contributions can help shape the project.

Tracking policies and member engagement.
WG: Identify actions to take based on member organisations' policies and track progress.
WG: Determine who will take on the work of identifying contributors and potential time commitment.

Policy analysis and interpretation.
Namrata has suggested starting a thread to gather input and ideas on a policy project. The group has planned to share their project with the organisation's leads and Standards WG to focus on policies that impact their agenda and create synergy.

Providing feedback in the policymaking process.
The group discussed the need for help in identifying upcoming policy consultations and providing sample language for responses. The group agreed on a plan to reach out to members and org leads for input on policy consultations and potentially collaborate with other groups for best practices.

Action Items
[ ] Get in touch with member organisations and inquire about policies they plan to respond to in the next six months.
[ ] Start a conversation with the policy working group members and organisation leads regarding the policy manual projects.
[ ] Draft blog post on AI environmental impact legislation endorsement.
[ ] Share policy manual project with other SWG.
