Item view context menu active even in hidden state

After opening an item (from any list view) the context menu (one with Up, Down, Star, Share and OpenLink buttons) is not visible but is active and responds to touch input.

In another words, you can click any context menu button even when the menu is hidden.
This also prevents scrolling if the scroll gesture begins in the area where the (hidden) menu is placed.
