I'm able to replicate this error with contract simulation. Is it possible to proceed without a successful simulation? I can test it on a locally forked network instead.

how can we estimate gas parameters then and also know that the deployment transaction won't revert? if the transaction fails, then the factory will be burned for good

Since this is a testnet I'd be happy to fund the deployer account with an excessive amount of gas tokens and also simulate locally to ensure we're within range. I'm willing to bear the risk of the nonce getting burned.
